i believe that what has brought this here to not today is vagueness um the documents that i've read the testimony that i've heard is no contact now there's no definition of no contact i intend to define no contact by the time i'm finished here this morning will say mr gilliam you're walking a fine line i understand all the testimony but the um and i'm going i am going to find that there is no violation there's no contact order um and but i i am going to i want to point out a few things just to make sure that it's abundantly clear when a court looks at things
it's not just in a vacuum the when i look at the fact that you are an ex-council member you know what door everybody goes in so therefore you you know what time the council meetings are you if you wanted this process server or frank ostrosky to serve these folks he could have looked at their name tags because most of the time council members wear name tags he could have gone in and listened to the when each one of them were introduced he would have known who to serve as they walked out he could have looked at their name tags in front of them as they were sitting
at the meeting without you being anywhere being being present i'm saying all that because i'm going to define no contact and i want to make sure that you understand that there are if you place yourself in a position if you're in publix and you're walking down the aisle and you run into mr dot because your dad's coming the other way it's up to you to turn around and walk the other way go down the other aisle not run out the front door of publix because you were there you didn't know mr dodd was there that's different than going to a council meeting you know
occurs on tuesday night you know it occurs at this time and you know the council members go in this door that's where they um had the no contact order been sustained and the usual no contact order not to cover the 100 feet you'd have been in violation now that's not to say that if that was given to you that you would have stayed 300 feet away i'm not saying that today i'm finding there's no violation what i am going to do is is to define the no contact order from here on out to the tendency of this case whereby no contact is no contact if you you're not to come
within 100 feet of any of the parties listed in the previous no contact order again i use the description of publix i'm not precluding you from going around town and doing your business you don't have to go running out the door if they're walking down the street it's in your best interest cross the street walk down the other side if you happen to accidentally run into them in public go down the other eye no contact means no contact no third party contact except and all of this is except for in connection with legal proceedings um there's no electronic
contact no comments on facebook no direct contact on facebook no text messages no emails no telephone calls no verbalization by yourself and no third party contact except for that contact if again like the service is a good a good example you have to have conservative process call mr percept have observed the process done deal you have to come within 500 feet of their residence you have to come within 100 feet of any vehicle that they normally operate or occupy and all of this is you're not to do this um knowingly obviously you know there's cars
parked in a parking lot you happen to walk through the parking lots oh look there's a video and he's walking back that's not what i'm talking about you know exactly what i'm talking about it's purposeful contact that's the reason i went through the description of in front of the city council building you know they work there you know they go there you know what time they go there it would be the same thing in a no contact order where somebody picks their child up every day at five o'clock and the person with the no contact over just happens to show up
out front they knew they were going to be there so it's purposeful is there any question as to what the no contact order is from here until dependency of this action any mistake mr garland and mr gordon's been in this business for three or seven months i think he can explain to you exactly what i mean by that no contact or if there is any questions um and i do notice that mr barnett's here so he he knows the rules too so is there anything from anyone else
