How To Look Up State Laws For Mask Wearing

It’s easy to look up your state laws to learn all about wearing masks. Each state is required to have the State Constitution online.

  1. Simply do a search for your “(INSERT STATE NAME) Constitution”.
  2. Then search your state’s constitution for the keyword: “Mask” or “Masks”

Bans on Masks By State

The provisions of anti-mask laws vary considerably by state. A small minority of states have near blanket prohibitions on wearing masks in public places.

Illegal To Wear a Mask In Alabama

For example, under Alabama’s anti-mask law, which was enacted to help fight the KKK, it is an offense, punishable by up to 30 days in jail if a masked person loiters or remains in a public place.

It Is Illegal To Wear a Mask In New York

Similarly, New York’s anti-mask law, makes it an offense, punishable by up to 15 days in jail, for two or more masked persons to congregate in a public place (unless a city proactively creates an exception for entertainment). The law was used by police against Occupy Wall Street protesters in 2011.

Illegal To Wear a Mask In South Carolina

More commonly, states have bans on face coverings but with explicit exceptions. For example, South Carolina’s anti-mask law states that no person over 16 shall wear a mask that conceals their identity in public. It, though, has exceptions for traditional holiday costumes (such as at Halloween), masks involved in one’s employment, theater productions, and gas masks during a civil defense drill. It is punishable by up to a year in jail.

It is Illegal To Wear a Mask In North Carolina, Louisiana, West Virginia, Louisana & Minnesota

Similar provisions exist in GeorgiaNorth Carolina, and WestVirginiaLouisiana and Minnesota also add an exception for religious face coverings.

It Is Illegal To Wear a Mask In Virginia

Virginia’s anti-mask law adds the potential for an exemption for a medical reason or if the governor declares an exemption during an emergency.

State of Georgia 1990 Statue Allowing Mask for Public Health, Protests & Demonstrations

None of these statutes though exempt wearing a mask for a public health need or the use of masks during protests or demonstrations. Although in Georgia, the state Supreme Court did read down the statute in 1990 to only apply when the wearer intends to threaten, intimidate, or commit violence.

MOST STATES BANS ON MASKS WHILE COMMITTING OR INTENDING TO COMMIT AN OFFENSE

Several states make it an offense to wear a mask if one commits a crime or intends to commit a crime (see CaliforniaMichiganNorth DakotaOhioOklahomaFlorida, and Washington DC). In some states, anti-mask laws require the wearer intend to deprive another person of their constitutional rights (see ConnecticutDelaware, and New Mexico).

Importantly, in Washington DC, North Dakota, Florida, and Oklahoma, in addition tomaking it an offense to wear a face-covering when committing a crime, it is an offense to wear a mask with the intent to intimidate or harass another person.

Up to 180 Days IN Jail Time For Wearing Masks In Some States

In North Dakota and Oklahoma, this is punishable up to a year in jail; in Washington DC, up to 180 days in jail; and in Florida, up to 60 days in jail. Intimidation and harassment are often subjective, making these provisions ripe for abuse by authorities, whether that involves racial profiling or targeting a demonstrator who may be engaged in a strongly worded protest.

More generally, individuals should not be concerned that they will be punished under an anti-mask statute if they are caught jaywalking or engaged in a minor violation of the law.

Illegal To Wear Masks In Florida | Florida Law | Florida Constitutional Law

In my search I can quickly search the State of Florida Constitution to find:

Florida Statue 876.12 which states:

Wearing mask, hood, or other device on public way.—No person or persons over 16 yearsof age shall, while wearing any mask, hood, or device whereby any portion of the face is so hidden, concealed, or covered as to conceal the identity of the wearer, enter upon, or be or appear upon any lane, walk, alley, street, road, highway, or other public way in this state.

A special thanks to Brian Mudd on iHeartRadio for not leaving me alone in my findings. Mudd writes,

“So yes, anyone 16 and older on public property wearing a mask is breaking the law in Florida. Surprise! Now, the purpose of this law is vastly different than the purpose of wearing masks most recently. It’s under the chapter of Florida law governing criminal behavior and mask orders have of course been based on a declared public health emergency. And that public health emergency is key in describing why this law hasn’t been applied for over a year.”

Here’s a quick refresh on what happens during a declared state of emergency:

In short, as of September 25, 2020 our great florida Governor Ron DeSantis has emergency management powers when he quickly removed state-level restrictions on businesses, such as restaurants. De Santis’ Executive Order 20-244 stated:

No COVID-19 emergency ordinance may prevent an individual from working or from operating a business. This preemption is consistent with Executive Order 20-92.

Restaurants, including any establishment with a food service license, may not be limited by a COVID-19 emergency order by any local government to less than fifty percent (50%) of their indoor capacity.  If a restaurant is limited to less than one hundred percent (100%) of its indoor capacity, such COVID-19 emergency order must on its face satisfy the following:
quantify the economic impact of each limitation or requirement on those restaurants; and
explain why each limitation or requirement is necessary for public health.
Nothing in this order preempts or supersedes a non-COVID-19 municipal or county order.
Section 4.  Suspension of COVID-19-related Individual Fines and Penalties

This order, consistent with Executive Order 20-92, suspends the collection of fines and penalties associated with COVID-

19 enforced upon individuals.

Section. 5 Effective Date

This order is effective immediately.

It Is Illegal To Wear Mask In Florida, Nc, Georgia, New York, Washington Dc &Amp; Many Other States

Florida Statute 252.36 Emergency management powers of the Governor.—

(1)(a) The Governor is responsible for meeting the dangers presented to this state and its people by emergencies. In the event of an emergency beyond local control, the Governor, or, in the Governor’s absence, her or his successor as provided by law, may assume direct operational control over all or any part of the emergency management functions within this state. She or he shall have the power through proper process of law to carry out the provisions of this section. The Governor is authorized to delegate such powers as she or he may deem prudent.

(b) Pursuant to the authority vested in her or him under paragraph (a), the Governor may issue executive orders, proclamations, and rules and may amend or rescind them. Such executive orders, proclamations, and rules shall have the force and effect of law.

Mudd continues, “Just as has been the case with other legal questions regarding policy mandated by the state and local authorities during the pandemic, once a state of emergency is declared it supersedes all other laws and executive action, as described in the statute, is the law.”

Governor DeSantis Granted Local Governments The Ability To Issue Mask Mandates IF They Can Produce Reasoning To The State

So far I cannot find anywhere Miami-Dade or City of Miami has produced any proof to override the governor’s executive order. I have submitted a public records request and tweeted at both RINO Mayor Carlos Gimenez:

 Governor DeSantis, through his emergency declaration, has granted local governments the ability to issue mask mandates due to the state of emergency but not to enforce them with penalties. Thus, that’s the law that retains supremacy until the emergency declaration ends. Though to your point, the day the emergency declaration does finally end, it will be illegal once again in Florida – unless that law is changed.

See your Governor’s Executive Orders by searching the state website or go to DuckDuck Go and search “EXECUTIVE ORDERS GOVERNOR (INSERT GOVERNOR’S NAME HERE). Then you’ll need to read through the Governor’s Executive Orders (aka. EOs).

REPEALING ANTI-MASK LAWS DURING THE PLANDEMIC

Anti-mask laws are not necessary. Most states do not have such laws on their books with seemingly few negative repercussions. These laws have long created First Amendment concerns, and during the COVID-19 pandemic, they create confusion in the public health response and the possibility for abuse. Attorneys general and governors should announce that they will not enforce anti-mask laws during the pandemic. State legislatures should move rapidly to either repeal these laws or narrowly tailor them to address both public health and First Amendment concerns.
